1Acceptance of Terms

By accessing our website, purchasing a ticket, attending an event, or using any MyCheekySocial service, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.

If you do not agree with these Terms, you should not use our services.

MyCheekySocial reserves the right to amend these Terms at any time. Updated versions will be posted on our website and become effective upon posting.

2Eligibility

You must be at least eighteen (18) years of age to participate in any MyCheekySocial event or service.

By participating, you represent and warrant that:

• You are at least 18 years old.
• You have the legal capacity to enter into this Agreement.
• The information you provide is accurate and truthful.
• You will comply with all event guidelines, venue requirements, and this Agreement.

MyCheekySocial reserves the right to refuse service to any person at its sole discretion.

3Events & Attendance

MyCheekySocial hosts structured, in-person social events designed to help participants make new friends. MyCheekySocial events are friendship events, not dating events.

Attendance is voluntary and participation does not guarantee any specific outcome, including friend matches, friendships, or ongoing connections.

Guests are responsible for arriving on time and following event instructions provided by hosts and staff.

Event age ranges are guidelines only and may vary.

Venue locations, schedules, hosts, formats, and event details may change from time to time.

4Event Reschedules, Postponements & Cancellations

From time to time, events may be rescheduled, postponed, relocated, modified, or cancelled due to factors including but not limited to:

• Weather
• Venue issues
• Attendance considerations
• Operational needs
• Staff availability
• Safety concerns
• Circumstances beyond our reasonable control

If an event is rescheduled, participants may:

• Attend the new date;
• Transfer to another available event; or
• Request a refund.

If a participant's plans change, tickets remain valid and may be used toward a future event, subject to availability.

Tickets do not expire.

5Ticketing, Payments & Refunds

Event ticket purchases are processed through Eventbrite or another authorized ticketing platform.

While third-party platforms process transactions, MyCheekySocial assists guests with ticket-related questions and refund requests.

Refunds for events that MyCheekySocial cancels or reschedules are handled directly by MyCheekySocial. Participants do not need to request a refund through Eventbrite; email info@mycheekysocial.com and we will refund you directly. Attending an event and not receiving a friend match is not grounds for a refund. See The Cheeky Guarantee.

Rescheduled Events

If an event is rescheduled and a participant cannot attend the new date, they may request a refund.

Participant Schedule Changes

If a participant chooses not to attend an event for personal reasons, tickets may generally be applied as non-expiring credit toward a future event.

Conduct-Related Removal

No refunds, credits, transfers, or compensation shall be provided to participants removed from events or services due to violations of this Agreement or the Code of Conduct.

6The MyCheekySocial Circle & Invitations

The MyCheekySocial Circle is a free, invite-only community. Invitations into the Circle, complimentary places at events, and invitations to private gatherings are extended at MyCheekySocial's sole discretion.

No Entitlement

Attending an event does not entitle any participant to an invitation into the Circle or to any complimentary place, gathering, or introduction. Circle membership and its benefits may be changed, suspended, or withdrawn at any time.

Other Constellation Brands

Circle members may receive invitations to events or services offered by other brands within the Constellation, a group of in-person dating, friendship and networking brands. Any such event or service is provided by that brand and is governed by that brand's own terms and policies.

7Code of Conduct & Participation Policy

Respectful Behaviour

All participants are expected to treat fellow guests, hosts, venue staff, contractors, and MyCheekySocial personnel with courtesy, respect, and professionalism.

Participants agree to:

• Respect personal boundaries.
• Use respectful language.
• Accept another participant's decision not to continue communication.
• Follow host instructions.
• Contribute positively to the experience of others.

Zero-Tolerance Conduct

The following conduct is prohibited:

• Harassment
• Bullying
• Intimidation
• Threats
• Verbal abuse
• Discriminatory conduct
• Unwanted physical contact
• Physical aggression
• Stalking behaviour
• Continued unwanted contact
• Disruptive behaviour
• Retaliation against guests, hosts, or staff
• Conduct causing another person to feel unsafe
• MyCheekySocial maintains a zero-tolerance policy regarding these behaviors.

Host & Staff Safety

The safety of hosts, staff, venue partners, contractors, and participants is paramount.

MyCheekySocial reserves the right to remove, suspend, or permanently ban any participant whose conduct causes another participant, host, contractor, venue partner, or staff member to feel unsafe, threatened, intimidated, harassed, or uncomfortable.

This includes conduct occurring:

• At events
• Through email
• Through text messages
• Through telephone communications
• Through social media
• Through any communication relating to MyCheekySocial services

Any participant whose conduct causes a host, staff member, contractor, or venue partner to decline future involvement with that participant may be permanently removed from MyCheekySocial services.

Consequences

MyCheekySocial may take any action it deems appropriate, including:

• Warnings
• Event removal
• Suspension
• Withdrawal of Circle membership
• Permanent bans
• Referral to law enforcement where appropriate

MyCheekySocial reserves the right to determine, in its reasonable discretion, whether a violation has occurred.

8Suspension & Termination

MyCheekySocial may suspend, restrict, or terminate access to services at any time where a participant:

• Violates these Terms.
• Violates the Code of Conduct.
• Provides false information.
• Engages in unlawful conduct.
• Threatens staff, hosts, participants, or venue partners.
• Uses services in a manner harmful to MyCheekySocial or other participants.

Termination may occur without prior notice where reasonably necessary to protect safety, operations, or other participants.

9Intellectual Property

All website content, trademarks, logos, event materials, text, graphics, software, photographs, videos, marketing materials, and related content remain the exclusive property of The Cheeky Lab, LLC or its licensors.

No content may be copied, reproduced, distributed, modified, sold, or used without prior written permission.

10Privacy & Data Protection

MyCheekySocial processes personal information in accordance with its Privacy Policy.

By using our services, participants consent to the collection, storage, processing, and use of information necessary to provide services and operate the business.

Where applicable, MyCheekySocial will comply with relevant privacy and data protection laws.

11Electronic Communications

Participants consent to receive communications electronically, including:

• Event updates
• Schedule changes
• Smart-Card and friend match notifications
• Account notices
• Service announcements

Participants may opt out of marketing communications while continuing to receive service-related communications.

12Third-Party Platforms & Venues

MyCheekySocial may utilize third-party venues, ticketing providers, payment processors, software providers, and service partners.

MyCheekySocial is not responsible for the policies, actions, availability, or performance of third-party providers.

Participants remain subject to applicable venue rules and requirements.

13Disclaimer of Warranties

Services are provided on an "as-is" and "as-available" basis.

MyCheekySocial makes no warranty regarding:

• Event attendance levels
• Participant compatibility
• Friend match success
• Relationship outcomes
• Website availability
• Uninterrupted service

To the fullest extent permitted by law, all implied warranties are disclaimed.

14Limitation of Liability

To the fullest extent permitted by law, MyCheekySocial, its affiliates, officers, employees, contractors, hosts, and representatives shall not be liable for:

• Indirect damages
• Incidental damages
• Consequential damages
• Emotional distress claims
• Lost profits
• Lost opportunities
• Relationship outcomes
• Participant interactions

In no event shall MyCheekySocial's total liability exceed the amount paid by the participant for the specific service giving rise to the claim.

15Indemnification

Participants agree to indemnify and hold harmless MyCheekySocial and its affiliates, employees, hosts, contractors, venue partners, and representatives from claims, damages, liabilities, costs, and expenses arising from:

• Violations of these Terms;
• Participant conduct;
• Misuse of services;
• Violations of law;
• Violations of third-party rights.

16Dispute Resolution

Before initiating legal proceedings, participants agree to first contact MyCheekySocial and attempt informal resolution for at least sixty (60) days.

17Arbitration Agreement

Any dispute, claim, or controversy arising from these Terms or MyCheekySocial services shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA"), except where prohibited by law.

Arbitration may be conducted by telephone, video conference, online submission, or written submissions unless otherwise required.

Nothing in this section prevents either party from seeking temporary injunctive relief where appropriate.

18Governing Law & Venue

These Terms shall be governed by the laws of the State of California.

Exclusive venue for disputes not subject to arbitration shall be Los Angeles County, California.

Participants consent to personal jurisdiction in California for purposes of enforcing these Terms.

19Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

20Entire Agreement

These Terms, together with any referenced policies, constitute the entire agreement between MyCheekySocial and participants regarding the services described herein.
